Welcome to Wavey!
This End-User License Agreement (EULA) and these terms and conditions outline the rules and regulations for the use of Wavey's Application.
By accessing this app we assume you accept these terms and conditions. Do not continue to use Wavey if you do not agree to all of the terms and conditions stated on this page.
1. DEFINITIONS
• "App" refers to the Wavey mobile application.
• "User", "You", "Your" refers to you, the person logged on this app and compliant to the Company's terms and conditions.
• "We", "Our", "Us" refers to our Company.
2. USER ACCOUNTS
• To use certain features of the App, you must register for an account.
• You must provide accurate and complete information and keep your account information updated.
• You are responsible for maintaining the confidentiality of your account and password.
3. USER CONDUCT AND CONTENT POLICY
This App includes user-generated content. By using this App, you agree to the following terms regarding your conduct and the content you post.
No Tolerance for Objectionable Content or Abusive Users: There is no tolerance for objectionable content or abusive users. You may not post, share, or transmit any content that is:
• Sexually explicit or pornographic
• Hateful, defamatory, discriminatory, or mean-spirited
• A threat of harm to any person or group of people
• Abusive, harassing, or bullying
• Unlawful or in promotion of illegal activities
• Spam or unsolicited commercial content
• Infringing on any third-party's intellectual property rights
Content Filtering: We use a combination of automated filtering systems and human moderation to monitor and remove objectionable content.
Mechanism to Report Content: All users have a clear and simple mechanism to flag and report any content they deem objectionable from within the app.
Mechanism to Block Users: All users have a clear and simple mechanism to block any other user from within the app to cease any further communication with them.
24-Hour Response Policy: We commit to acting upon any report of objectionable content or abusive user behavior within 24 hours. This action includes removing the offending content and ejecting the user who provided it from the App.
4. DATA STORAGE AND USE

• User data, including personal information and chat messages, are stored on Firestore.
• We take reasonable measures to protect your data.
5. INTELLECTUAL PROPERTY
The App and its original content, features, and functionality are owned by Wavey and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
6. TERMINATION
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Breaching the User Conduct and Content Policy will result in immediate termination and ejection from the service.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall Wavey, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
(i) your access to or use of or inability to access or use the App;
(ii) any conduct or content of any third party on the App;
(iii) any content obtained from the App; and
(iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
8. GOVERNING LAW
These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.
9. SUBSCRIPTIONS
Wavey offers auto-renewable subscriptions for premium features.
• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
10. CHANGES TO TERMS
We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
